General terms and conditions of sale

Any purchase of our products and supplies implies unreserved acceptance of our general terms and conditions of sale. This translation is provided for information only; in the event of any discrepancy, the French version prevails.

Article 1 — Acceptance of orders

The date on which an order is registered is the date of receipt of your written order, accompanied by a deposit cheque for 30% of the price including VAT. Any order for imported hares for December and January must be registered no later than 5 December 2026.

Written order required

Orders must be placed in writing (letter or e-mail) and accompanied by a deposit of 30% of the amount including VAT.

Imported hares

Registration deadline: 5 December 2026 for December and January deliveries.

Article 2 — Carriage and packaging

Prices are quoted ex our warehouses, carriage extra. Our goods always travel at the consignee's own risk. In the event of damage, and in accordance with Article 105 of the French Commercial Code (Code de Commerce), the consignee must enter precise reservations on the delivery receipt, confirm these facts to the carrier by registered letter within 72 hours, and notify us of them within the same period. The crates remain at the disposal of our establishment. If they are not returned, a charge of €5 including VAT will be invoiced to you.

Carriage charged in addition

Prices are ex GIBIS warehouses in Chatte (38160); transport costs are invoiced separately.

Reservations to the carrier within 72 hours

In the event of damage, precise reservations on the delivery note and a registered letter to the carrier within 72 hours.

Article 3 — Delivery

Our delivery times are given for guidance only and depend on the date on which the order is received. No delivery delay that is unforeseeable, or that results from the carrier's liability, may under any circumstances give rise to cancellation of the order or to the payment of compensation or penalties.

Indicative lead times

Delivery dates are set by mutual agreement, subject to the date on which the order is received.

Article 4 — Terms of payment and pricing

Unless expressly stipulated otherwise by us, collection or dispatch of the game requires immediate payment of the full price before departure. In accordance with Article 3 of Law No. 92-1442, any late payment after the due date will give rise to late-payment interest calculated at one and a half times the statutory interest rate in force. The prices in this price list are strictly net, including VAT (VAT 5.5%). Should the statutory VAT rate be changed by the State, the price would be recalculated by applying the new rate. Our prices are firm while stocks last. For imported game, we register your orders for the desired date, with invoicing according to the delivery date. Our prices remain valid barring printing errors. In view of the situation and the continual increases in raw material prices, we reserve the right to change our prices at any time.

Payment in full before dispatch

The full price must be paid before the game is collected or dispatched, unless otherwise agreed.

VAT 5.5%

Net prices including VAT, at the reduced VAT rate of 5.5% applicable to live game.

Article 5 — Penalty clause

It is expressly stipulated that, if the goods are not paid for by the due date and a formal notice to pay within eight days, sent by registered letter with acknowledgement of receipt, remains without effect, an indemnity equal to 15% of the invoice price including VAT will become immediately payable by way of penalty clause, independently of the statutory or contractual interest provided for in the preceding article.

Article 6 — Game: live arrival guaranteed

LIVE ARRIVAL GUARANTEED. All game must be checked in the presence of the driver. In the event of mortality, state this on the express delivery note. Any dead game not reported on the delivery note will not be refunded by our establishment. Notify us by telephone on 04 76 38 31 01 within 24 hours. ANY GAME KEPT IN CAPTIVITY BY YOU WILL NOT BE COVERED BY THE GUARANTEE.

Inspection in the presence of the driver

Check the condition of the animals on delivery and record any mortality on the delivery note before signing.

Notification within 24 hours

In the event of mortality on delivery, notify us by telephone on 04 76 38 31 01 within 24 hours.

Exclusion of guarantee

Any game kept in captivity by you after delivery is no longer covered by the live arrival guarantee.

Article 7 — Jurisdiction clause

The Commercial Court of Grenoble (Tribunal de commerce de Grenoble) has sole jurisdiction to hear all disputes that may arise from the performance of these terms and their consequences. This clause also applies in the event of multiple defendants or third-party warranty claims (appel en garantie).

Exclusive jurisdiction of the Commercial Court of Grenoble (Tribunal de Commerce de Grenoble) for all disputes relating to these general terms and conditions of sale.

Article 8 — Force Majeure

In the event of force majeure resulting in non-delivery, no indemnity or damages will be due. Funds already paid will be refunded. Placing an order with us implies acceptance of our terms and conditions of sale.

Refund of deposits

In the event of force majeure preventing delivery, funds already paid are refunded in full.

Article 9 — Disputes and retention of title

All goods delivered remain the property of the supplier until paid for in full (Laws of 12 May 1980 and of 25 January 1985). Any dispute shall fall within the jurisdiction of the competent courts of Grenoble. We reject any novation of, or derogation from, this jurisdiction clause.

Animals delivered remain the property of GIBIS until the invoice has been paid in full.

Article 10 — Performance of orders for imported hares

The performance of an order for wild-caught imported hares always depends on the capture. Captures remain subject to weather conditions. Captures of wild animals are uncertain and their success is not guaranteed.

GIBIS holds the mandatory veterinary, health and environmental approvals. GIBIS staff hold the certificate of competence for managing a breeding establishment and have been trained in animal welfare and biosecurity.
